1. Services Provided
1.1 Scope of Work
Haus320 agrees to design, develop, and deliver a website for the Client as detailed in the package the Client selects. The scope of work will not at any time exceed that which was agreed upon prior to payment, unless the buyer wishes to purchase a site upgrade.
1.2 Revisions
Each package comes with a number of revisions. Haus320 will not be responsible for any revisions beyond those contained in the selected package. Additional revisions can be purchased with payment provided each revision is paid for upfront. Revisions can only be made within 30 days of website completion. After 30 days, the revision window is closed, and Haus320 will not be responsible for making further revisions to the site as the client now has full ownership of the website.
Basic: 2 revisions, Premium: 4 revisions, Ultimate: 6 revisions.
2. Payment Terms
Project Fee:
The total fee for the project is determined by the scope of work, the package client selects on the call with our team, and any additional discounts or add-ons. This is to be paid in full by the terms set by our team.
3. Client Responsibilities
3.1 Content Provision
Client agrees to provide all necessary content as requested by the Haus320 Design team, including but not limited to: text, images, videos, fonts, colors, logos, and any other materials required for the website, in a timely manner. Should the client delay in providing the requested assets for a period of greater than 90 days, their project will be terminated and no refund will be offered.
3.2 Hosting and Domain
The client is responsible for all website hosting, domain name registration fees and any other fees accumulated through the development process. Haus320 will not be responsible for any fees or costs once production begins.
4. Project Timeline
Completion Date:
The project is expected, but not guaranteed, to be completed within [4-8] weeks from the start date, contingent upon timely receipt of all required materials from the Client.
5. Post-Approval Work
5.1 Additional Work
Once the website is built and approved by the Client, ownership will be transferred to the client. Any additional pages or modifications of any size or complexity will not be the responsibility of Haus320 unless specified in a separate agreement.
5.2 Maintenance Training
Haus320 will provide an initial training on how to maintain the website via a screen shared call. The recording of that call will be shared with the client.
5.3 Paid Maintenance
Haus320 will not be responsible for ongoing maintenance unless the Client has purchased a Maintenance Package at a monthly recurring cost.
6. Payment Refund Policy
6.1 No Refund Policy
Client understands and agrees that all payments made under this agreement are non-refundable under any circumstances. Due to the nature of the services provided, including strategic planning, setup, ongoing labor, payouts, and immediate allocation of resources upon receipt of payment, all payments are final.
Work begins immediately upon payment, and as such, the Client acknowledges that there is no trial period, no money-back guarantee, and no option for partial or full refund.
The Client further agrees not to initiate a chargeback or dispute through their payment provider for any reason, understanding that doing so would constitute a breach of this agreement. Any chargeback attempt will be treated as a fraudulent action and may result in immediate legal action, along with the Client being held liable for all associated legal fees, collections fees, and damages incurred by the Company.
6.2 Immediate Service Commencement Acknowledgment
The Client acknowledges and agrees that work commences immediately upon receipt of payment. This includes, but is not limited to, research, team allocation, system configuration, creative planning, Discord management setup, and other service-related actions.
As such, payment is deemed to be for services already rendered or in process, not a deposit or a reservation for future services.
6.3 Digital Service Classification
Digital Services Acknowledgment
The Client acknowledges that the services rendered are intangible, customized digital services, and not physical or returnable goods. As such, the services are exempt from traditional consumer refund or return policies under most chargeback guidelines.
7. Intellectual Property and Ownership
Upon full payment, the Client will own the final website design and all associated files. Haus320 retains the right to display the website in its portfolio.
8. Limitation of Liability
Haus320’s liability under this Agreement for any claim arising out of or related to this Agreement will not exceed the total amount paid by the Client to the Developer.
9. General Provisions
9.1 Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of California.
9.2 Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, representations, and understandings.
9.3 Amendments
Any amendments to this Agreement must be reflected in these terms.
9.4 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
10. Term And Termination.
This Agreement will remain in effect until terminated by either party. To terminate this Agreement, you MUST contact Haus320 directly. We are not responsible for the continued use of our service if you point your domain to a different website. To terminate your service, you must contact us so that we can cancel your billing. Haus320 also reserves the right to suspend or terminate the Service at any time and at our sole discretion and without notice. We may suspend or terminate your use of the Service if you are violating our Acceptable Use Policy.
Every section of this Agreement that by its nature should survive being terminated survives termination with no limitation, inclusive of Your Content, Our Intellectual Property, Warranty Disclaimers, Limitation Of Liability, Indemnification, Discourse or Dispute Resolution, and Additional Terms and Conditions.
12. Warranty Disclaimers
Haus320 Services are provided as it is. We make no guarantees or warranties, implied or expressed, about the services provided. At no time will any advice or information, informal or formal, provided orally or in writing, obtained by you from Haus320 shall ever create any warranty or guarantee. Haus320 makes no warranty or guarantee that the services provided will be timely, uninterrupted, or error-free, meet your requirements or expectations, or be free from harmful components.
13. Limitation Of Liability
In no event will Haus320 be liable with respect to any claims related to the Services or this Agreement. This includes any damages, loss of profit, revenue, or data, whether tangible or intangible, any damages related to access to or the inability to access or use the Services, or any damages related to the loss or corruption of any content or data.
14. Indemnification
As the client, you are responsible if you do something that results in a lawsuit against Haus320. As the responsible party you will be liable to cover all legal costs. To the fullest extent permitted by law, you agree to indemnify and hold harmless Haus320 from and against all damages, losses and expenses of any kind arising out of or related to your breach of the Agreement, your User Content, Your Site, any claims from your End Users and your violation of any law or regulation or the rights of any third party. This includes attorneys’ fees and costs.
15. Dispute Resolution
As the client, you agree to attempt to work out any dispute with Haus320 before filing a claim against them by emailing hello@haus320.com with a description of your claim. Haus320 agrees to work to resolve the dispute informally by following up via phone, email, or other methods. Claims may only be filed on an individual basis and not as part of a class action. You may not bring a claim as a plaintiff of a class member in a class, consolidated, or representative action. Class actions, class arbitrations, private attorney consolidation, and general actions with other arbitrations are not allowed.
16 Additional Terms
16.1 Agreement
This Agreement is the entire agreement between us regarding your use of Haus320. If we change the agreement in a way that reduces your rights, we will give you notice and an opportunity to cancel. If you are reading this in a language other than English, the English language version will control.
16.2 Controlling Law
This Agreement and the Services shall be governed in all respects by the laws of the State of California, without regard to its conflicts of law provisions.

Privacy Policy
This Privacy Policy details how we collect and use your personal information on the Services. Any capitalized terms not defined in this Privacy Policy have the meanings outlined in our Terms of Service. Please contact us if you have any questions.
1. Collection
When you use the Services, we collect the following information.
1.1 Account Information. We collect your name, email, address, contact number, and other information when you supply it to us.
1.2 Third Party Information. When you connect a Third-Party Service to your Account, those services may provide us with information that we need to save to your Account to continue providing the Services.
1.3 Payment Information. Any payment information you supply is transmitted via a secure, encrypted connection to the Payment Processor. We don’t store your payment information, only the information needed to identify you or the payment.
1.4 Communications. We may store any communication you have with us to use for future inquiries about your Account.
1.5 Content. We save all content, text, files, and images that you upload to the Services, whether public or private, for use in the Services.
1.6 Device Information. We store information about the interactions you have with the Services, such as the device type, IP address, and browser type. We use this information to improve the Services.
1.7 Location Information. We store information about where you are accessing the Services from. We use this information to improve the Services by providing information relevant to your location.
2. Sharing Information
We may share your information as described below.
2.1 Authorized Third Parties. We may share your information with Third-Parties that you authorize.
2.2 Law Enforcement. We may share your information with Third Parties when it becomes necessary to comply with reasonable requests of law enforcement or national security requests for specific information.
2.3 Those working for Haus320. We use Third Parties to help us secure, analyze, and improve the Services. These Third Parties may access and store your information to perform tasks and will do so with the same level of protection for your information.
2.4 Aggregated or Anonymized Information. We analyze data across the system to help improve the Services. We may, from time to time, disclose the analysis of data from usage of the Services for the benefit of the broader community. We will not disclose the data itself, only the analysis or findings from the research.
3 Protecting your information.
We take the following steps to protect your information.
3.1 Data Security. We ensure that data is stored on secure servers. Any payment information will be transferred via an encrypted connection.
3.2 Retention. We retain your information for as long as needed to provide the Services. You can ask for your information to be deleted by contacting hello@haus320.com
3.3 Location. Information that you submit to our services will be stored in the United States, but may be transferred to Third Parties in other locations.
3.4 Modification Information. Information that you have stored on the Services can be modified at any time or deleted via the Services or by contacting hello@haus320.com.
4. End User Information.
We have no relationship with the End Users of Your Site.
5. Cookies, Analytics and Tracking
We use “Cookies” (small sets of information stored as text) and “Pixels” (images used to identify web visitors) to provide a more personalized experience via the Services and third-party services and to measure and analyze usage of the Services. Here is a list of those services (not a complete list).

Acceptable Use Policy
This Acceptable Use Policy outlines some examples of prohibited conduct in connection with our Services. Any capitalized terms not defined in this Acceptable Use Policy have the meanings outlined in our Terms of Service. Please contact us if you have any questions.
We expect our users to behave responsibly. As a user of Haus320, you agree not to misuse the Services or help anyone else do so. You cannot do any of the following in connection with the Services:
1. Abusing And Disrupting The Services
1.1 Do not breach or bypass any security or authentication measures.
1.2 Do not test for vulnerabilities.
1.3 Do not access or tamper with or use any nonpublic areas of the Services.
1.4 Do not interfere with any user, host, or network.
1.5 Do not take apart, decompile, or reverse engineer any part of the Services in an effort to gain access to things such as source code.
1.6 Do not take action that imposes an unreasonable load on our system or a third-party service. We reserve the right to determine what is reasonable.
1.7 Do not provide your password to any other person or use the service via a shared password.
2. Spamming
2.1 Do not send spam or any other unsolicited communications or promotions. We reserve the right to determine what spam is.
3 Impersonating And Deceiving Others
3.1 Do not do anything false or fraudulent.
3.2 Do not impersonate another person, company, organization, or entity.
3.3 Do not do anything unethical. We reserve the right to determine what is ethical.
4. Stealing
4.1 Do not sell the Services unless authorized to do so by Haus320 or publish or use the Services on any other network or system other than that provided by Haus320.
5. Infringing, Misappropriating, and Violating Rights
5.1 Do not infringe on anyone’s copyright, trademark, or other intellectual property.
5.2 Do not violate anyone’s privacy rights.
6. Being rude
6.1 Do not do or post anything harassing, threatening, abusive, violent, offensive, sexually explicit, or obscene.
6.2 Do not advocate bigotry or hatred against any person or group based on their race, ethnicity, religion, gender, nationality, age, or disability.
7. Breaking The Law
7.1 Do not do anything that violates the law including local laws.
If we deem that you are violating any of these policies or any other behavior that we deem abusive or inappropriate, we may take action against your Account and Your Site. We reserve the right to remove any content that violates this policy or, in some cases, remove the Account and Your Site altogether without any refund at our sole discretion.
